What Are Some Unusual Cases Involving Motorcycle Accidents?
I recently handled a case that was a little unusual. A motorcyclist was rear-ended in a traffic stop on the freeway and when he was struck from behind, he was projected over his own handlebars. While he was lying in the street, the same vehicle then proceeded to run over him.
When the driver of the vehicle realized what they had done, they thought they were on top of him so they backed up to get off of him and then ran him over a second time. The gentleman suffered very significant injuries both from the initial rear-end impact and then from being run over and then backed over by the defendant who was trying to minimize the injury and subsequently caused significantly more injury.
What Happens When Traumatic Injury Occurs As A Result Of The Motorcycle Accident?
We often see very traumatic injuries resulting from motorcycle accidents because of the mechanism of the injury. The motorcyclist would often be projected off of their bike in the scenario of a turning vehicle in front of the motorcycle so that the motorcycle hit the side of the vehicle and the motorcycle was then projected over the vehicle, which is something that can result in head injuries. It is very common to see fractures because motorcycle accidents are a very trauma inducing event.
What Happens In A Case Where Someone Was Injured Or Died As A Result Of A Motorcycle Accident?
They would have a wrongful death claim for the loss of their loved one, which would include any economic damages they suffered, medical bills, funeral expenses, and burial costs. They would be entitled to pain and suffering and the loss of the economic support from the deceased loved one.
Do Clients Become So Emotionally Scarred They Do Not Want To Ride A Motorcycle Again?
I have seen both sides of that. I represented a gentleman who continued to ride even after losing a portion of his leg in a motorcycle accident, and then I have also seen people who dropped their motorcycle and chose to never ride it again just because they suffered some bruises and abrasions, so it would actually depend on the individual.
In a general sense, motorcyclists tend to be a little more daring than motorists to a certain extent, because it takes a certain type of personality to be a motorcyclist and someone who loved it would stick with it, despite multiple accidents.
